According to the Consumer Protection Law, every seller or provider is required to share their contact details in a visible manner. These details should include the company name, physical address, phone number, and email. Thanks to this right, consumers can directly contact the seller in case of a problem and seek a resolution without experiencing victimization. Moreover, transparent contact information also demonstrates the reliability of the seller. It is recommended not to shop from sellers who hide or incompletely provide their information.
What Are the Preliminary Information Form and Distance Sales Agreement
With the spread of e-commerce, several legal regulations have been introduced to protect consumers. Among the most important of these are the preliminary information form and the distance sales agreement. Both documents aim to guarantee the rights of both consumers and sellers in online shopping and have become legal requirements under Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts.
Preliminary Information Form
The preliminary information form includes the written details that must be provided by the seller or provider to the consumer before a distance sale (e.g., online purchase) transaction. This form ensures that the consumer is fully informed of the purchasing process before making a decision.
The form must include:
Seller information
Basic characteristics of the product/service
Price information (including taxes)
Payment, delivery, and return terms
Information regarding the right of withdrawal
Any additional charges or delivery costs (if applicable)
Distance Sales Agreement
This agreement forms the legal basis of the relationship between the consumer and the seller in the online environment. It defines the obligations of both parties. The seller is obliged to deliver the product or service in full and on time, while the consumer is obligated to make the payment and receive the delivery. This agreement also serves as a legal reference in the event of disputes between the parties.
Right of Withdrawal and Usage Conditions
The right of withdrawal is one of the most important consumer protection mechanisms in e-commerce. The consumer has the right to return a product within 14 days of receipt without providing any reason. This right gives consumers the freedom to change their minds or return products that do not meet expectations.
Situations Where the Right of Withdrawal Cannot Be Used
However, some products are not covered by the right of withdrawal:
Customized or personalized products
Products not suitable for return for hygiene reasons (e.g., underwear, cosmetics)
Opened food products
Digital content such as software or DVDs (if the packaging has been opened)
In all other cases, consumers can exercise their right of withdrawal.
Return Process and Refund of Payment
When the right of withdrawal is exercised, the seller is obliged to refund the full amount of the product to the consumer within 14 days of the return. The refund must be made using the same method of payment the consumer used. For example, a payment made by credit card must be refunded to the same card. Additionally, it is important to clarify who bears the return shipping cost. If this is not specified in the preliminary information form, it is assumed to be the seller’s responsibility.
Consumer Rights in Cargo Delivery
The successful and timely delivery of a product to the consumer marks the completion of the e-commerce process. However, in some cases, products may be damaged during shipping or delivery may be delayed.
Damaged Products: If the product packaging is open or the product is damaged upon delivery, the consumer should create a damage report with the courier. This report provides the consumer with legal rights for returns and exchanges. Otherwise, the seller may claim the damage was caused by the consumer.
Consumer Rights for Defective Products and Services
Defective Product: This means that the product does not match its advertised features or does not fulfill its intended use.
In case of a defective product, the consumer may request:
Free repair of the product
Replacement with a new one
A price reduction
Cancellation of the sale and refund
These rights can be exercised within the 2-year warranty period.
Warranty Certificate and Consumer Assurance
A warranty certificate indicates that the product is under the protection of the manufacturer or importer for a certain period. Any malfunction that occurs within the warranty period must be resolved without any additional cost to the consumer. If a warranty certificate is not provided with the product, the consumer has the right to request one. Having the product invoice is sufficient for the warranty to be valid.
Protection of Personal Data and Privacy Policy
Since personal information is also shared in online shopping, data security is of great importance. Under the Personal Data Protection Law (KVKK):
Consumer data cannot be used without consent.
Explicit consent is required for sharing data with third parties.
Data can only be stored for the intended purpose.
e-Commerce websites are obligated to comply with these rules. Otherwise, administrative fines may be imposed.
Consumer Complaints and Application Channels
When a consumer believes their rights have been violated, they can use various application methods. One of the most common solutions in Turkey is the Consumer Arbitration Committees.
How to Apply to the Consumer Arbitration Committee?
Applications are made to the district or provincial arbitration committees depending on the value of the product or service. Applications can be submitted:
In person, By mail, Online via e-Government (Consumer Information System – TÜBİS) The application file must include documents such as invoices, payment receipts, and correspondence. Arbitration committees usually decide within 3 to 6 months, and their decisions are binding.
